By accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. The Services are intended for users who are at least 18 years old.

Our Services

The information provided when using the Services is not intended for distribution to any person or entity in any jurisdiction where such distribution would be contrary to law or regulation, or which would subject us to any registration requirement. We shall own this Submission and be entitled to its unrestricted use for any lawful purpose, without acknowledgment or compensation to you.

Subscriptions

Billing & Renewal

Your subscription continues and automatically renews unless canceled. You consent to recurring charges on a monthly billing cycle without requiring prior approval for each charge.

Cancellation

You can cancel at any time by contacting us. Your cancellation takes effect at the end of the current paid term. Email office@kliker.systems if you have questions or are unsatisfied.

Fee Changes

We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user, you agree not to:

Systematically retrieve data to create collections, databases, or directories without permission.

Trick, defraud, or mislead us or other users, especially to learn sensitive account information.

Circumvent, disable, or interfere with security-related features of the Services.

Disparage, tarnish, or otherwise harm us and/or the Services.

Use information from the Services to harass, abuse, or harm another person.

Make improper use of our support services or submit false reports.

Use the Services in a manner inconsistent with any applicable laws or regulations.

Engage in unauthorized framing of or linking to the Services.

Upload or transmit viruses, Trojan horses, or other malicious material.

Engage in any automated use of the system, including bots, scripts, or data mining tools.

Use the Services to compete with us or for any revenue-generating commercial enterprise.

User Generated Contributions

The Services do not currently offer users the ability to submit or post public content. Any Contributions you transmit may be treated in accordance with the Services' Privacy Policy.

Contribution License

We may access, store, and process any information you provide following the Privacy Policy. By submitting feedback, you agree we can use it for any purpose without compensation. You retain full ownership of all your Contributions.

Third-Party Websites

The Services may contain links to Third-Party Websites and Third-Party Content. These are not investigated, monitored, or checked for accuracy by us, and we are not responsible for Third-Party Websites or Content accessed through the Services.

Services Management

We reserve the right to monitor the Services for violations, take appropriate legal action, refuse or restrict access to any Contributions, and manage the Services to protect our rights and facilitate proper functioning.

Privacy Policy

We care about data privacy and security. By using the Services, you agree to be bound by our Privacy Policy. The Services are hosted in the United States — continued use from other regions constitutes consent to data transfer and processing in the United States.

WE RESERVE THE RIGHT TO DENY ACCESS TO AND USE OF THE SERVICES TO ANY PERSON FOR ANY REASON, WITHOUT NOTICE OR LIABILITY. If your account is terminated or suspended for any reason, you are prohibited from registering a new account under your name, a fake name, or any third party's name.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We cannot guarantee the Services will be available at all times and may suspend, discontinue, or modify the Services at any time without notice to you.

Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

Dispute Resolution

Informal Negotiations

Parties agree to first attempt to negotiate any Dispute informally for at least 30 days before initiating arbitration, commencing upon written notice from one Party to the other.

Binding Arbitration

Unresolved disputes will be finally and exclusively resolved by binding arbitration under AAA Commercial Arbitration Rules, taking place in Wyoming. No dispute may be commenced more than 2 years after the cause of action arose.

Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update the information on the Services at any time, without prior notice.

Disclaimer

Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

Indemnification

You agree to defend, indemnify, and hold us harmless — including our subsidiaries, affiliates, officers, agents, partners, and employees — from and against any loss, damage, liability, claim, or demand (including reasonable attorneys' fees) arising out of: (1) use of the Services; (2) breach of these Legal Terms; (3) breach of your representations and warranties; (4) violation of a third party's rights, including intellectual property rights; or (5) any overt harmful act toward any other user.

User Data

We will maintain certain data you transmit to the Services for managing performance and your use. Although we perform regular routine backups, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.

Electronic Communications, Transactions, and Signatures

Visiting the Services, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. You agree to the use of electronic signatures, contracts, orders, and records.

SMS Text Messaging

Program Description

By opting in, you expressly consent to receive SMS messages to your mobile number, including appointment reminders, marketing communications, responses to inquiries, and special offers.

Opting Out

Reply "STOP" to any SMS message to stop receiving messages. You may receive a confirmation SMS. After this, you will no longer receive messages from us.

Message & Data Rates

Message and data rates may apply. Rates are determined by your carrier and mobile plan. Carriers are not liable for delayed or undelivered messages.

Miscellaneous

These Legal Terms and any policies posted by us constitute the entire agreement and understanding between you and us. Our failure to exercise any right or provision shall not operate as a waiver. We may assign any or all of our rights and obligations at any time. If any provision is determined to be unlawful, void, or unenforceable, it is deemed severable and does not affect the validity of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship between you and us as a result of these Legal Terms.
